Bienvenido a JOB Innovation ("nosotros", "nuestro" o "la Empresa"), empresa especializada en soluciones de inteligencia artificial, desarrollo de software, seguridad, domótica y automatización, con sede en Buenos Aires, Argentina. Al acceder o utilizar nuestro sitio web jobinnovation.com.ar, nuestras aplicaciones o cualquiera de nuestros servicios, usted acepta estar sujeto a los siguientes Términos y Condiciones. Le recomendamos leerlos detenidamente antes de utilizar nuestros servicios.

1. Aceptación de los términos

Al utilizar nuestros servicios, usted confirma que ha leído, comprendido y aceptado estos Términos y Condiciones en su totalidad. Si no está de acuerdo con alguna disposición, le solicitamos que no utilice nuestros servicios. El uso continuado de nuestros servicios constituye la aceptación de cualquier modificación posterior a estos términos.

2. Descripción de los servicios

JOB Innovation ofrece los siguientes servicios profesionales:

Software con inteligencia artificial: Desarrollo de aplicaciones móviles y web potenciadas con IA, incluyendo chatbots, análisis predictivo, procesamiento de lenguaje natural y visión artificial.
Seguridad con visión artificial: Sistemas de videovigilancia inteligente con detección de personas, objetos y comportamientos, alertas en tiempo real y análisis automatizado.
Domótica y automatización: Soluciones de automatización inteligente para hogares y empresas, control de dispositivos IoT, iluminación, climatización y accesos.
Integración de sistemas: Conexión de sistemas existentes con soluciones de IA, APIs inteligentes, automatización de procesos (RPA) y flujos de trabajo optimizados.
Crypto y blockchain: Asesoramiento financiero en el ecosistema crypto y desarrollo de soluciones blockchain, incluyendo smart contracts, DeFi, wallets y tokenización de activos.
Consultoría en IA: Asesoramiento estratégico para identificar oportunidades de inteligencia artificial, evaluación de viabilidad y diseño de estrategias de implementación.

Los servicios específicos, alcance, plazos y condiciones económicas se definen en contratos o propuestas comerciales individuales acordados por escrito con cada cliente.

3. Obligaciones del usuario

Al utilizar nuestros servicios, usted se compromete a:

Proporcionar información veraz, completa y actualizada cuando sea requerida para la prestación de los servicios.
Colaborar de manera oportuna en la entrega de materiales, aprobaciones y feedback necesarios para el avance de los proyectos.
No utilizar nuestros servicios para fines ilegales, fraudulentos o que infrinjan derechos de terceros.
No intentar acceder sin autorización a sistemas, redes o datos de JOB Innovation o de otros usuarios.
Respetar la confidencialidad de la información sensible intercambiada en el marco de los proyectos.
Utilizar el sitio web y las aplicaciones de conformidad con las leyes aplicables y las buenas prácticas.

4. Propiedad intelectual

Salvo acuerdo expreso por escrito, JOB Innovation retiene todos los derechos de propiedad intelectual sobre el código fuente, diseños, metodologías, herramientas internas y materiales desarrollados por nosotros. Los entregables específicos acordados en cada contrato se rigen por los términos de cesión o licencia establecidos en dicho contrato.

El cliente garantiza que posee los derechos necesarios sobre los contenidos, marcas, imágenes y materiales que proporcione para el desarrollo del proyecto, y que su uso no infringirá derechos de terceros. JOB Innovation no será responsable por reclamaciones derivadas de materiales proporcionados por el cliente.

5. Limitación de responsabilidad

En la máxima medida permitida por la ley aplicable, JOB Innovation no será responsable por daños indirectos, incidentales, especiales, consecuentes o punitivos, incluyendo pero no limitados a pérdida de beneficios, datos, uso, buena voluntad u otras pérdidas intangibles, derivados del uso o la imposibilidad de uso de nuestros servicios.

Nuestra responsabilidad total frente al cliente, por cualquier causa relacionada con los servicios prestados, no excederá el monto efectivamente pagado por el cliente por los servicios objeto de la reclamación en los doce (12) meses anteriores al evento que dio origen al reclamo.

No somos responsables por interrupciones del servicio debidas a fallas de terceros (hosting, APIs, servicios cloud), fuerza mayor o causas ajenas a nuestro control razonable.

6. Términos de pago

Cuando corresponda, los términos de pago se establecerán en el contrato o propuesta comercial de cada proyecto. En general:

Los precios y modalidades de facturación se acuerdan por escrito antes del inicio del trabajo.
Los pagos vencidos pueden dar lugar a la suspensión de los servicios hasta regularizar la situación.
Las facturas emitidas se rigen por la normativa tributaria argentina vigente.
Los costos de terceros (dominios, hosting, APIs de pago, etc.) pueden facturarse por separado o incluirse según lo acordado.

7. Garantías y exclusiones

JOB Innovation presta sus servicios con la debida diligencia profesional y en conformidad con las especificaciones acordadas. No obstante, los servicios se prestan "tal cual" y "según disponibilidad". Excepto cuando se establezca expresamente por escrito en un contrato, renunciamos a todas las garantías implícitas, incluyendo las de comerciabilidad, idoneidad para un propósito particular y no infracción.

No garantizamos resultados específicos de negocio, posicionamiento en buscadores, número de descargas o métricas similares, salvo que se acuerde expresamente en un contrato con objetivos medibles.

8. Terminación

Cualquiera de las partes puede dar por terminada la relación de servicios conforme a lo establecido en el contrato correspondiente. En ausencia de disposiciones específicas, el cliente puede solicitar la terminación con un preaviso razonable, y JOB Innovation podrá terminar el servicio en caso de incumplimiento grave por parte del cliente, incluyendo falta de pago o violación de estos términos.

En caso de terminación, el cliente abonará los servicios prestados hasta la fecha y los costos incurridos no recuperables. Las disposiciones sobre propiedad intelectual, limitación de responsabilidad, indemnización y ley aplicable permanecerán vigentes tras la terminación.

9. Ley aplicable

Estos Términos y Condiciones se rigen por las leyes de la República Argentina. Cualquier controversia derivada de estos términos o de los servicios prestados estará sujeta a la jurisdicción de los tribunales competentes de la Ciudad Autónoma de Buenos Aires, Argentina.

10. Resolución de disputas

Antes de iniciar cualquier procedimiento judicial, las partes se comprometen a intentar resolver las disputas de buena fe mediante negociación directa. Si no se alcanza un acuerdo en un plazo de treinta (30) días desde la notificación escrita de la controversia, cualquiera de las partes podrá recurrir a los tribunales competentes.

Para contratos con clientes internacionales, las partes podrán acordar mecanismos alternativos de resolución de disputas, como arbitraje, en un anexo o contrato específico.

11. Indemnización

El usuario acepta indemnizar, defender y mantener indemne a JOB Innovation, sus directores, empleados, colaboradores y representantes, frente a cualquier reclamación, demanda, daño, pérdida, costo o gasto (incluyendo honorarios legales razonables) que surja de o esté relacionado con: (a) el uso de nuestros servicios en violación de estos términos; (b) la violación de derechos de terceros por materiales proporcionados por el usuario; (c) el incumplimiento de las obligaciones del usuario bajo estos términos o bajo un contrato de servicios.

12. Divisibilidad

Si alguna disposición de estos Términos y Condiciones fuera declarada inválida, ilegal o inaplicable por un tribunal competente, dicha invalidez no afectará las demás disposiciones, que permanecerán en pleno vigor y efecto. Las disposiciones inválidas se modificarán en la medida mínima necesaria para hacerlas válidas y aplicables, preservando la intención original de las partes.

13. Modificaciones

JOB Innovation se reserva el derecho de modificar estos Términos y Condiciones en cualquier momento. Los cambios serán efectivos desde su publicación en esta página. La fecha de "Última actualización" refleja la última modificación. Le recomendamos revisar periódicamente estos términos. El uso continuado de nuestros servicios tras la publicación de cambios constituye la aceptación de los mismos. Para contratos vigentes, las modificaciones no afectarán los términos ya acordados por escrito, salvo consentimiento expreso del cliente.

Welcome to JOB Innovation ("we," "our," or "the Company"), a company specialized in artificial intelligence solutions, software development, security, smart home, and automation, headquartered in Buenos Aires, Argentina. By accessing or using our website jobinnovation.com.ar, our applications, or any of our services, you agree to be bound by the following Terms and Conditions. 1. Acceptance of Terms

By using our services, you confirm that you have read, understood, and accepted these Terms and Conditions in their entirety. If you do not agree with any provision, we ask that you do not use our services. Continued use of our services constitutes acceptance of any subsequent modifications to these terms.

2. Description of Services

JOB Innovation offers the following professional services:

AI-powered software: Development of mobile and web applications powered by AI, including chatbots, predictive analytics, natural language processing, and computer vision.
AI-powered security: Intelligent video surveillance systems with detection of people, objects, and behaviors, real-time alerts, and automated analysis.
Smart home and automation: Intelligent automation solutions for homes and businesses, IoT device control, lighting, climate, and access management.
Systems integration: Connection of existing systems with AI solutions, intelligent APIs, robotic process automation (RPA), and optimized workflows.
Crypto and blockchain: Financial advisory in the crypto ecosystem and blockchain solution development, including smart contracts, DeFi, wallets, and asset tokenization.
AI consulting: Strategic advisory to identify artificial intelligence opportunities, feasibility assessment, and implementation strategy design.

Specific services, scope, timelines, and financial terms are defined in individual contracts or commercial proposals agreed upon in writing with each client.

3. User Obligations

By using our services, you agree to:

Provide truthful, complete, and up-to-date information when required for the provision of services.
Collaborate in a timely manner in the delivery of materials, approvals, and feedback necessary for project progress.
Not use our services for illegal, fraudulent, or third-party rights-infringing purposes.
Not attempt unauthorized access to JOB Innovation's or other users' systems, networks, or data.
Respect the confidentiality of sensitive information exchanged in the context of projects.
Use the website and applications in accordance with applicable laws and best practices.

4. Intellectual Property Rights

Unless expressly agreed in writing, JOB Innovation retains all intellectual property rights over source code, designs, methodologies, internal tools, and materials developed by us. Specific deliverables agreed upon in each contract are governed by the assignment or license terms set forth in that contract.

The client warrants that they hold the necessary rights to the content, trademarks, images, and materials they provide for project development, and that their use will not infringe third-party rights. JOB Innovation shall not be liable for claims arising from materials provided by the client.

5. Limitation of Liability

To the maximum extent permitted by applicable law, JOB Innovation shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising from the use or inability to use our services.

Our total liability to the client, for any cause related to the services provided, shall not exceed the amount actually paid by the client for the services subject to the claim in the twelve (12) months preceding the event that gave rise to the claim.

We are not responsible for service interruptions due to third-party failures (hosting, APIs, cloud services), force majeure, or causes beyond our reasonable control.

6. Payment Terms

When applicable, payment terms shall be established in the contract or commercial proposal for each project. In general:

Prices and billing modalities are agreed in writing before work begins.
Overdue payments may result in suspension of services until the situation is regularized.
Invoices issued are governed by applicable Argentine tax regulations.
Third-party costs (domains, hosting, payment APIs, etc.) may be billed separately or included as agreed.

7. Warranties and Disclaimers

JOB Innovation provides its services with due professional diligence and in accordance with agreed specifications. However, services are provided "as is" and "as available." Unless expressly set forth in writing in a contract, we disclaim all implied warranties, including those of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee specific business results, search engine rankings, number of downloads, or similar metrics, unless expressly agreed in a contract with measurable objectives.

8. Termination

Either party may terminate the service relationship in accordance with the provisions of the corresponding contract. In the absence of specific provisions, the client may request termination with reasonable notice, and JOB Innovation may terminate the service in case of material breach by the client, including non-payment or violation of these terms.

Upon termination, the client shall pay for services rendered up to the date of termination and non-recoverable costs incurred. Provisions regarding intellectual property, limitation of liability, indemnification, and governing law shall remain in effect after termination.

9. Governing Law

These Terms and Conditions are governed by the laws of the Argentine Republic. Any dispute arising from these terms or the services provided shall be subject to the jurisdiction of the competent courts of the Autonomous City of Buenos Aires, Argentina.

10. Dispute Resolution

Before initiating any judicial proceeding, the parties agree to attempt to resolve disputes in good faith through direct negotiation. If no agreement is reached within thirty (30) days from the written notice of the dispute, either party may resort to the competent courts.

For contracts with international clients, the parties may agree on alternative dispute resolution mechanisms, such as arbitration, in an annex or specific contract.

11. Indemnification

The user agrees to indemnify, defend, and hold harmless JOB Innovation, its directors, employees, collaborators, and representatives, from and against any claim, demand, damage, loss, cost, or expense (including reasonable legal fees) arising from or related to: (a) use of our services in violation of these terms; (b) infringement of third-party rights by materials provided by the user; (c) breach of the user's obligations under these terms or under a service contract.

12. Severability

If any provision of these Terms and Conditions is declared invalid, illegal, or unenforceable by a competent court, such invalidity shall not affect the remaining provisions, which shall remain in full force and effect. Invalid provisions shall be modified to the minimum extent necessary to make them valid and enforceable, preserving the original intent of the parties.

13. Modifications to Terms

JOB Innovation reserves the right to modify these Terms and Conditions at any time. Changes will be effective upon their publication on this page. The "Last updated" date reflects the most recent modification. We recommend reviewing these terms periodically. Continued use of our services after the publication of changes constitutes acceptance thereof. For existing contracts, modifications shall not affect terms already agreed in writing, except with the client's express consent.
